Terms of Service

Please read these terms carefully before using Telsense services. By accessing or using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

By creating an account, purchasing a domain, or otherwise accessing or using any service provided by Telsense Inc. ("Telsense," "we," "our," or "us"), you agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or policies incorporated herein by reference. If you do not agree to these Terms, you must immediately discontinue use of our services. These Terms apply to all visitors, users, and others who access the service.

2. Eligibility

You must be at least 18 years of age to use our services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not prohibited from using our services under applicable law. If you are using Telsense on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at security@telsense.com if you suspect any unauthorized use of your account. Telsense will not be liable for any loss resulting from unauthorized use of your account.

We reserve the right to terminate or suspend accounts that violate these Terms, engage in fraudulent activity, or are otherwise deemed inappropriate at our sole discretion.

4. Domain Registration and Transfer Services

Telsense acts as an accredited domain registrar and reseller. All domain registrations are subject to availability and the applicable registry policies for each top-level domain (TLD). Domain registrations are non-transferable except as expressly permitted herein.

Domain transfers to Telsense are subject to a 60-day lock period after registration or a previous transfer, as required by ICANN policy. You agree to provide the correct authorization code (EPP code) and to unlock your domain prior to initiating a transfer.

Telsense does not guarantee the availability of any specific domain name. Domain registration fees are paid in advance and are non-refundable once the registration has been processed with the registry, except as stated in our Refund Policy.

5. Fees, Billing, and Renewal

All fees are quoted in US Dollars and are exclusive of applicable taxes unless stated otherwise. By providing a payment method, you authorize Telsense to charge all applicable fees, including registration, renewal, transfer, and add-on service fees.

Domain registrations expire at the end of the registration period. Telsense will send renewal reminder notices to the email address on file. If auto-renewal is enabled, we will automatically charge your payment method on file prior to the expiration date. It is your responsibility to maintain current payment information and contact details.

Telsense reserves the right to change pricing at any time. Price changes will be communicated via email and will take effect upon your next renewal or purchase.

6. Acceptable Use Policy

You agree not to use Telsense services to:

  • Register domains for the purpose of cybersquatting, typosquatting, or phishing
  • Distribute spam, malware, ransomware, or other malicious content
  • Violate any applicable local, state, national, or international law
  • Infringe upon the intellectual property rights of any third party
  • Engage in any activity that interferes with or disrupts Telsense services
  • Harvest or collect user data without consent
  • Use our services in connection with illegal gambling, fraud, or money laundering

Telsense reserves the right to suspend or terminate any domain registration or service associated with violations of this Acceptable Use Policy, with or without prior notice.

7. Intellectual Property

All content, software, design, graphics, logos, and trademarks displayed on the Telsense platform are the exclusive property of Telsense Inc. or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

8. Disclaimers and Limitation of Liability

Our services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, Telsense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or domain names, arising from your use of or inability to use our services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to Telsense in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Telsense Inc., its officers, directors, employees, agents, and third-party service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of Telsense services.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or our services shall first be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction for matters involving intellectual property or unauthorized use of services.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on our platform at least 14 days before the changes take effect. Your continued use of our services following the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of our services.
